11. Payment Terms, Default, and Collections
a. Payment Due Dates
Payment for all installations, products, and services provided by Trimlight SoCal is due immediately upon completion of installation, unless otherwise specified in writing on the customer’s invoice or service agreement. Deposits or progress payments may be required prior to scheduling or commencing work.
b. Late Payments
Any invoice not paid within three (3) business days of completion may accrue a late fee of 3% per month (or the maximum amount permitted by law) on any unpaid balance. Warranty coverage and system activation may be temporarily suspended until payment is received in full.
c. Default
If any account remains unpaid beyond ten (10) business days, Trimlight SoCal reserves the right to:
- Suspend or terminate services or warranties,
- Refer the account to an external collections agency, and/or
- File a mechanic’s lien or other legal claim against the property where services were performed, as permitted under California law.
- Pursue legal action in court to recover the unpaid balance, including reasonable attorney’s fees, court costs, and any applicable interest or collection expenses.
d. Recovery of Costs
In the event of nonpayment, you agree that Trimlight SoCal shall be entitled to recover all reasonable costs of collection, including attorney’s fees, filing fees, lien recording fees, and collection agency costs, in addition to the outstanding balance owed.
e. Returned or Reversed Payments
Any returned checks, chargebacks, or reversed credit card transactions will incur a $50 processing fee and may be subject to collection proceedings.
f. Acknowledgment
By approving a quote, paying a deposit, or allowing installation to proceed, you acknowledge and agree to these payment and collection terms, and understand that unpaid balances may result in legal collection action or a mechanic’s lien against your property.
